Prime Minister Narendra Modi’s recent visit to Chief Justice DY Chandrachud’s residence for Ganesh Puja has sparked significant controversy, with numerous legal experts and activists criticizing the move as a breach of judicial conduct and an affront to the principle of separation of powers. Activist-lawyer Prashant Bhushan took to X to express his concerns, citing the Code of Conduct for Judges which mandates that judges maintain a degree of aloofness to preserve the dignity of their office. Bhushan labeled the visit as “disturbing,” arguing that the judiciary’s role in upholding citizens’ fundamental rights and ensuring executive accountability is compromised when such interactions occur.
Bhushan contended that allowing a Prime Minister to attend a private religious function at a Chief Justice’s home undermines judicial impartiality and violates the Code of Conduct. He also criticized the public display of religious events, suggesting it conflicts with the judiciary’s duty to uphold secularism. Senior lawyer Indira Jaising echoed similar concerns, accusing the Chief Justice of compromising judicial independence. She urged the Supreme Court Bar Association (SCBA) to publicly address what she views as a breach of the separation between the Executive and the Judiciary. Conversely, Bar Council of India Chairman and BJP Rajya Sabha MP Manan Kumar Mishra defended the visit, describing the Ganesh Aarti as a socio-religious event rather than a political meeting. Mishra argued that the visit was a private matter and that criticism of such ceremonial interactions is unwarranted.
Following the event, Prime Minister Modi posted on X: “Joined Ganesh Puja at the residence of CJI, Justice DY Chandrachud Ji. May Bhagwan Shri Ganesh bless us all with happiness, prosperity and wonderful health.” The All India Lawyers’ Union criticized the visit as “highly improper,” asserting that any action compromising the judiciary’s independence is detrimental to public trust and constitutional values.
